Understanding Builders’ Warranties

When you buy a new home, it comes with a builder’s warranty or home warranty that guarantees certain components of the home for a set period of time. Some warranties are offered by the builder, while others are administered by third parties. It’s important to understand what the warranty on your home covers, how long that coverage lasts and who you should contact if you have any concerns or questions.

Most new home warranty packages follow a 1-2-10 format to reflect the number of years each type of component is covered.

Workmanship – 1 year

A workmanship warranty covers issues that stem from improper installation of drywall, doors, siding, stucco, paint and other non-structural parts of the house. It does not cover damage caused by other sources, for example other people, pets, or natural disasters.

Systems – 2 years

The systems warranty protects your home’s mechanical systems including the HVAC ductwork, plumbing and electric wiring. If any of those systems fail within the warranty period, you may be able to have the problem repaired or the faulty component replaced at no cost to you.

Major structural – 10 years

This warranty covers the major “building blocks” of your home: the foundation, framing, roof and other structural elements. A major structural defect is something that would cause the house to be unsafe to live in, such as a collapsing or sinking foundation.

Know what to ask

If you aren’t clear about what is covered by your home warranty, ask the warranty representative. They will go over the warranty terms when you meet with them around the time of purchasing your home. Make sure you understand what is covered, how long coverage lasts and what to do if you need to file a claim.

What is not covered by a home warranty?

Even within the stated time period, a warranty does not cover problems that result from homeowner carelessness, neglect or normal use. It also doesn’t cover damage from extreme weather, natural disasters or accidents such as someone backing a car into the siding.

Home warranties don’t include appliances such as stoves and refrigerators, which are covered by individual manufacturer warranties. Note that if you undertake remodeling or DIY projects within the coverage period they may void your warranties.

Can warranties be transferred?

By law, home warranties are transferrable to new owners. The warranty covers the home itself regardless of who owns it or for how long.

What to do if you have a claim

First, know the proper procedures for filing a claim as required by the builder or warranty provider. Make your claim in writing. State the issue clearly and explain the facts of the situation. Take photos or collect other proof of the issue and submit materials in a timely fashion.
